These Terms and Conditions ("Terms") apply between Mahollo Recruitment Co., Ltd. (the "Company") as a service provider of a job search engine and apply tool called 5ARCHEEP (the "Platform"), which the Company has hired Mahollo Place Co., Ltd. to established and provide, and you, the job seeker and/or applicant ("User"). If you do not agree to comply with these Terms. The Company reserves the right to refuse to provide services to you. In this regard, if you continue to use the Company's platform and services, the company shall assume that the recruiter has read and understood these Terms and Conditions and you agree to be bound by all the terms and conditions herein. The Company reserves the right to amend these Terms and Conditions without notifying the Recruiter and/or obtaining your consent.

1. 1. Acceptance of Terms and Conditions

   1. 1.1 These Terms shall be binding on the User who uses the Platform's services as soon as the User clickes to accept these Terms and Conditions.
   2. 1.2 The User has read and understood these Terms and Conditions carefully and agreed to accept the conditions before starting to use the service
   3. 1.3 All Users shall use the Services in accordance with the terms set out in these Terms and Conditions. If there are any additional requirements for the service, The User must also comply with the requirements set forth in the additional Terms.

2. 2. Username and Password

   1. 2.1 The User agrees to maintain confidentiality and not disclose the username and password or any other security code (if any) for the use of the Platform services to any other person for any reason, and the Company shall not be liable for any damages incurred due to the loss of the username and password or any other security code (if any) or if any other person is aware of such username and password.

Except in cases where the Company's computer system, equipment, or related communications systems are damaged or are in the process of being improved or repaired or a force majeure event occurs. The Company reserves the right to suspend the service for modification and repair of the Platform without prior notice and shall not be considered the fault of the Company. The Company shall not be liable for any damages caused by force majeure or modifications and repairs of the Platform of such incidents.
   3. 3.3 The Company will not be liable for any damages, expenses, or losses that may occur from providing services which include delays in data transfer, data dissemination periods, Interruptions, or any other incident that hinders access to the connection of Platform services, display errors, system stability, computer viruses, If the company has taken care of it appropriately or according to the circumstances.
   4. 3.4 The User agrees and accepts to provide information data in various forms and types as requested by the Company as necessary for the benefit of the service.
   5. 3.5 The Company shall not be liable for any failure or defect in the provision of the Services, whether in whole or in part. As a result of non-compliance with these Terms and Conditions.
   6. 3.6 The User agrees and accepts that the user account is for the exclusive use and belongs solely to the user account holder only. The User may not transfer or lend their User Account to any third party, and any third party may not subtract the User Account from the User. In addition, any transaction or use of any service made by the User Account shall be deemed to be the User's own action and binding solely on the User.
   7. 3.7 The Company reserves the right to display advertisements for the Company, whether it is a legal entity or not, wishing to find and recruit the candidates. (The "Recruiter") or the third parties, including for the Platform and/or the Company itself, to provide services to users through the websites and Platform's applications
   8. 3.8 The Company will not be committed to providing the Services until the User has provided the Company with the information required necessary to provide the Services.

4. 4. Applicant's resume, application form, and other supporting documents for job application

   1. 4.1 The User agrees to record the profile and keep the information on the Platform. Or submit an application or other supporting documents for job application on the platform
   2. 4.2 Profile Collection Services or maintaining resumes or applications or other supporting documents for job applications on the Platform. The User agrees that the Company shall deliver the resume, application, or any other supporting documents for job application on various platforms to the Recruiter. The Company is only obliged to provide deliver the resume profile on the platform, or the application form, or other supporting documents to the Recruiter for recruitment purposes only.
   3. 4.3 The Company will consider the User’s resume profile when the Company deems that the information in the resume that the User has left on the platform matches the needs of the Recruiter. The Company will propose the User's resume to the Recruiter for consideration, and the Recruiter may forward the User’s resume or application or other supporting documents to the relevant parties. However, the Company cannot guarantee that the User\’s resume profiles will always be presented to the Recruiter.
   4. The User can search for the job position posting by the Recruiter, and the user can contact to the Recruiter. Such contact shall not bind the Company to be responsible for any damages that may occur to the User.
   5. 4.4 The Company may notify the User of the inaccuracy or inappropriateness of the job placement posted by the User on the Platform.
   6. 4.5 The Company has the absolute right to refuse to distribute, publish, forward, or cancel, including remove from the system of resume or job application or any other supporting documents that the service user has sent to the company or be recorded and stored in the platform system.
   7. 4.6 The Company may refuse, remove, or modify the User’s information, resume or application, or other supporting documents for job application that are contrary to the law, good morals or pornographic content. or for any other unlawful reason, including inaccurate information. error, incomplete, imperfect, deleted, modified, or defective. The Company may amend the information to be accurate and complete as it deems appropriate without notice.
   8. 4.7 The User hereby certifies and confirms that:

   9. 1) The resume or application or other supporting documents for job application, as well as any other details and information recorded and stored in the Platform system are accurate information. complete, true, and up-to-date. If there are any changes to such details and information,The User is obliged to correct and improve it to be accurate, complete, true and up-to-date at all times.

   10. 2) During the period of use of the website and/or application of the platform. The User agrees not to do anything that is contrary to the law or morals, and will not take any action that is considered to be a violation of any rights of the Company or any other person or may cause damage to the Company or other persons.

   11. 3) In the event that it is found the user has violated the law or conditions related to the user’s information, or whether there is an error in the information recorded and stored in the platform system, The Company reserves the right to transfer or remove, in whole or in part, such information, delete the user account, and/or suspend the use of the service at the company’s discretion without notice.

   12. 4) Resumes or applications or other supporting documents for job application that the User has submitted to the Company or are recorded and stored in the Platform system, if they contain the name, image, contact information, or personal information of another person, in whole or in part, or any copies of documents proving the existence of another person. The User certifies and confirms that the consent of the Data’s owner has been obtained and has the right to use the person\’s information or documents for the purpose of applying for or in connection with the job application. In this regard, the Company shall not be liable for any damages incurred or if any lawsuit or claim is made in the application of the above information or documents,

   13. 4.8 The Company will keep the resume or application or other supporting documents until the User wishes to delete such information from the system or according to the Company’s announcement to notify the User not less than 7 days in advance.

5. 5. Job Application

   1. 5.1 The User must register and create a resume or profile on the Platform and apply for a job using the resume deposited on the Platform only.
   2. 5.2 Applying for a job through this platform is deemed the user have carefully read and understood the qualifications of the applicant for any job position that has been announced or advertised or appeared on the platform.
   3. 5.3 The User certifies and confirms that they have the qualifications and skills announced or advertised on the platform.
   4. 5.4 The User acknowledges and agrees to cooperate in contacting government offices or any places in person according to the purposes of the recruiter in accordance with the job description announced or advertised (if any).
   5. 5.5 The User agrees that if any data specified in the information, or resume or application or other supporting documents for job application is not true, contrary to the law or good morals, or contains obscene content. or for any other unlawful reason, the company reserves the right to refuse, cancel, withdraw or amend information or resume or applications, or other supporting documents of the User. Or suspend the provision of services to the User without notice.
   6. 5.6 The Company has the absolute right to refuse to distribute, publish, forward, or cancel, including remove from the system of any information, resumes or applications or other supporting documents for job applications that the User has submitted to the Company or are recorded and stored in the Platform.
   7. 5.7 The User acknowledges and agrees that the Information, Content, Images, Videos or any form of presentation on any advertisement or notice on the Platform, the Company is not responsible for the content, information of the advertisements placed on the platform and there is no liability whatsoever that happened to the company in such matters.

6. 6. Application Screening

   1. 6.1 The Company may check the background or other supporting documents for job application deposited with the Platform for the User's good image before sending it to the Recruiter.
   2. 6.2 The Company may screen the application content, work history, or other materials deposited on the Platform before sending it to the Recruiter to prevent spam and advertising.
   3. 6.3 The Company may contact the User via email or telephone number specified in the resume or application, or other supporting documents for job application or other contact channels provided by the User for further investigation.
   4. 6.4 If the Company finds that the information provided or specified by the User on the Website or in the resume or other supporting documents for a job application is untrue or contrary to the law or peace or good morals, or any other information that may be interpreted in such way, including but not limited to content that is considered obscene, offensive, vulgar, inappropriate, threatening, defamatory, the Company reserves the right to remove or amend such information without prior notice to the User.

7. 7. Job Vacancy and Recommendation Search

   1. 7.1 The Company uses the User's search data history to develop the search for vacancies to better meet the User's needs.
   2. 7.2 The Company uses the information of the job that the User is interested in and the job that the User has applied for to introduce other vacancies to the User.
   3. 7.3 The company will keep the relevant users' information in the search for and recommendation of vacancies for a period of not more than 3 years.

8. 8. Responsibilities of the User

   1. 8.1 In the event that the User is under 20 years of age or does not have the age of majority by marriage, this condition must be involved and considered by a guardian.
   2. 8.2 The User shall maintain confidentiality and shall not disclose any password or other security code (if any) for using the Platform Services to any other person for any reason.
   3. 8.3 If the User breaches Clause 8.1 or 8.2 as mentioned above, it shall be deemed to be responsible for the user, the applicant, and/or the guardian of those individuals (as applicable) without any dispute,and the Company shall not be held liable for any liability.

9. 9. Limitation of Liability

   1. 9.1 The Company shall not be liable for any damages or disputes arising out of any loss of images, artworks, copies, data or resumes or applications, or other supporting documents, including documents in any form provided by the User to the Platform.
   2. 9.2 The Company shall not be liable under any circumstances, whether in terms of contract, violation, dispute, error, or defect that arises or may arise from the use of the platform service or any other factor that hinders the use of the platform service, or the loss of data or any damages resulting from incorrect use by the user themselves, or events arising from non-compliance with the terms and conditions herein, or events arising from force majeure.
   3. 9.3 The Company and any other person related to the Platform shall not be liable for any errors or damages incurred as a result of employment, including any transactions between the Recruiter and the User. This includes damages arising from the provision of information by the user or the recruiter. or caused by the actions of the user or the recruiter themself.
   4. 9.4 The reliability and accuracy of any announcement or advertisement appearing on the Platform is to the satisfaction of the User. The Company shall not be liable for any errors or damages arising from the information appearing in the announcements or advertisements on the Platform.
   5. 9.5 The company will not be responsible for any damages resulting from breach of contract, contract violations, or infringement of any individual's rights arising from the information, resume, application, or other supporting documents for job application provided by the user.
   6. 9.6 In cases where the platform links to other websites owned by third parties, such actions are solely for the convenience for users, and serve as Internet Navigation Tools. However, the company does not certify the content of such websites and will not be responsible for any loss or damage arising from, or related to the use of services, or content of those third-party websites.

10. 10. Public Relations

    1. The Company may send marketing emails, including Promotional News, An Interesting job position introduction, etc. The Users can unsubscribe from receiving such marketing emails on their own.

11. 11. Collection of Information for Marketing purposes.

    1. 11.1 The Company will gather statistics on visits to marketing emails to develop and deliver content that meets the users’ needs.
    2. 11.2 The Company will use the information from resumes for marketing analysis to offer content that meets the users’ needs.
    3. 11.3 The Company will gather statistics on the use of the websites and/or applications on the platform in order to design and develop the websites and/or platform’s applications to meet the users’ needs in a better version.
    4. 11.4 The Company may reach out to the User to seek feedback on services or usage, which will be utilized to enhance the Company's services.

12. 12. Personal Data Protection

    1. 12.1 The User acknowledges and consents to the Company using the User's information provided through the Platform for the performance of its obligations both under these Terms and Conditions and in accordance with relevant laws. The Company will carry out such actions in accordance with the "Personal Data Protection Policy."
    2. 12.2 After deleting the User's account or withdrawing the consent to collect, use and publish the User's personal data in the Platform system, the Company may retain the User's information for 90 days .
    3. 12.3 The User shall be solely responsible for the costs, damages, attorney's fees, court fees or any other expenses arising from the dispute resolution, if it appears and determined that the cause of termination of the contract is the fault of the User.

13. 13. Intellectual Property

    1. All text, images, sounds, content, trademarks, service marks, names, trade names, methods of presentation and any components, including intellectual property of any kind which been made available by the Company appearing on this Platform are all legally owned solely by the Company. And is protected by intellectual property law. The Recruiter is prohibited from copying the information on the Platform or other documents, or distribute or copy, or prohibit in any other actions that may cause the essence to change from the original without prior written permission from the company.

14. 14. Communication

    1. 14.1 The documents or letters which the Company has sent to the User by electronic mail (Email), communication channels on the Platform, and / or the address specified in the subscription registration or service registration, it is deemed that the User has known such contents of the documents or letter.
    2. 14.2 The User confirms that the e-mail address as specified by the User in any part of the Platform is an email Address that can be accessed to the user at any time. The User agrees that the correspondence, letters, and notices from the Company are sent to the User via email address, It is to notify the user in the correct manner and the recipient shall be deemed to have seen the contact from the date sent of an e-mail.

15. 15. Miscellaneous Terms

    1. 15.1 The Company reserves the right to amend the terms and conditions as well as the service fees and other fees, as well as to amend for an addition or reduction the platform’s ability without notifying the User in a prior advance. When the User accesses the Service after such amendments, and continues to use such services of the Platform, it shall be deemed that the User has accepted the terms and conditions.
    2. 15.2 These terms and conditions are interpreted and enforced in accordance with the laws of the Kingdom of Thailand.
